Terms of Use

The terms on which you may use this website, and the basis on which our EECA 2024 guidance is provided. Please read them.

These Terms of Use ("Terms") govern your access to and use of kerosoftware.com (the "website"), operated by Kero Software Sdn Bhd ("KERO", "we", "us"). By using the website, you agree to these Terms. If you do not agree, please do not use the website.

About this website

This website provides information about KERO's energy-management software and about Malaysia's Energy Efficiency and Conservation Act 2024 (EECA 2024). It is intended for businesses and professionals. We may update, change or remove content at any time without notice.

Not legal or compliance advice

Our EECA 2024 guides — including pages on the law, the Registered Energy Manager, energy audits, the energy management system, and penalties and deadlines — are general information prepared in good faith from Act 861 and the Energy Efficiency and Conservation Regulations 2024 (EECR 2024). They are not legal advice, and KERO is not a law firm, a Registered Energy Manager, a Registered Energy Auditor, or Suruhanjaya Tenaga.

Laws and regulations change, and how they apply depends on your specific circumstances. Always confirm your obligations with Suruhanjaya Tenaga (ST) or a qualified adviser before acting. KERO software supports your compliance work; it does not guarantee that you comply or "pass" — those responsibilities rest with you and the professionals the law designates.

Intellectual property

Unless stated otherwise, the content, design, text, graphics and the KERO name and logo on this website are owned by or licensed to Kero Software Sdn Bhd and are protected by applicable intellectual-property laws. You may view and print pages for your own reference. You may not reproduce, republish or exploit them commercially without our written permission. Third-party names and logos shown on this site remain the property of their respective owners and are used for identification only.

The KERO software

Access to and use of the KERO software application is provided separately, under the agreement between KERO and each customer. Those terms — not these — govern the application, its availability, data handling and support.

Third-party links

The website may link to third-party sites (for example, Suruhanjaya Tenaga). We provide these for convenience and do not control or endorse their content; we are not responsible for them. Following such links is at your own risk.

No warranty

The website and its content are provided "as is" and "as available". To the extent permitted by law, we make no warranties — express or implied — about the website's accuracy, completeness, reliability or fitness for a particular purpose. We do not warrant that the website will be uninterrupted or error-free.

Limitation of liability

To the extent permitted by Malaysian law, KERO will not be liable for any indirect, incidental or consequential loss, or any loss of profit, revenue, data or goodwill, arising from your use of (or inability to use) the website or your reliance on its content. Nothing in these Terms excludes liability that cannot be excluded by law.

Indemnity

You agree to indemnify KERO against claims, losses and costs arising from your misuse of the website or breach of these Terms.

Governing law

These Terms are governed by the laws of Malaysia, and you submit to the non-exclusive jurisdiction of the Malaysian courts.

Changes to these Terms

We may revise these Terms from time to time. The current version, and its effective date, will always appear on this page. Continued use of the website after a change means you accept the revised Terms.
